Welcome to PropView. These Terms and Conditions govern your use of our website, mobile applications, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

PropView provides an online property listing platform that connects property buyers, sellers, landlords, tenants, and real estate agents in South Africa and Zimbabwe.

• "Agent" refers to registered real estate professionals on the Platform.

3. User Registration

To access certain features of the Platform, you may need to register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Property Listings

Users who list properties on the Platform agree to:

• Provide accurate and truthful information about the property
• Have the legal authority to list the property
• Not misrepresent the condition, features, or price of the property
• Remove or update listings promptly when properties are sold or rented
• Comply with all applicable laws and regulations

PropView reserves the right to remove any listing that violates these Terms or is deemed inappropriate, misleading, or fraudulent.

5. Agent Responsibilities

Agents using the Platform must:

• Hold valid estate agent certification from the relevant regulatory body
• Comply with all professional and ethical standards
• Provide accurate information in all listings and communications
• Respond promptly to inquiries from potential buyers or tenants
• Not engage in any fraudulent or deceptive practices

6. Prohibited Conduct

Users may not:

• Use the Platform for any unlawful purpose
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Collect or harvest user information without consent
• Interfere with the Platform's operation or security
• Use automated systems to access the Platform without permission
• Violate any intellectual property rights
• Post discriminatory content or engage in discriminatory practices

7. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of PropView or its content suppliers and is protected by intellectual property laws. Users may not copy, reproduce, distribute, or create derivative works without express written permission.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind. PropView does not guarantee:

• The accuracy, completeness, or reliability of any listing or content
• That the Platform will be uninterrupted or error-free
• The quality or legality of any property listed
• The conduct or reliability of any user, agent, or third party

9. Limitation of Liability

To the maximum extent permitted by law, PropView shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. This includes but is not limited to:

• Loss of profits, data, or goodwill
• Property transactions or disputes
• Actions or omissions of other users or agents
• Service interruptions or technical issues

10. Indemnification

You agree to indemnify and hold harmless PropView, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through:

• Good faith negotiation between the parties
• Mediation, if negotiation fails
• Arbitration or court proceedings as a last resort

These Terms shall be governed by the laws of South Africa, and any legal proceedings shall be conducted in the courts of South Africa.

12. Modifications to Terms

PropView reserves the right to modify these Terms at any time. We will notify users of significant changes through the Platform or email. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

13. Termination

PropView may terminate or suspend your account and access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately.
